A law firm in Atlanta filed a lawsuit following threats by the Gwinnett County district attorney to prosecute businesses that sell products containing delta-8 or a similar chemical, delta-10.

 

 

According to the suit filed by Pate, Johnson & Church, District Attorney Patsy Austin–Gatson stated in January that delta-8 possession, sale, or distribution is against state law. A Friday email to the district attorney's office was not returned immediately.

 

 

The district attorney misunderstood hemp and hemp products under state law, according to the suit. It seeks a court order to stop Austin-Gatson from prosecuting business owners who sell delta-8 or delta-10 products.

 

 

 

Is Delta-8 legal in Georgia?

 

There's good news! Georgia currently allows the possession, sale, distribution, and use of delta-8 THC from hemp. Georgian law states that all hemp-derived cannabinoids and terpenes, flavonoids, isomers, salts, and seeds are allowed within the state. This coincides with federal law in the Agriculture Improvement Act (Farm Bill 2018, 2018).

 

 

The only illegal hemp-derived compound is delta-9-tetrahydrocannabinol (delta-9 or just THC), which is categorized as federally illegal under Schedule I of the Controlled Substances Act (CSA) and Georgia's own Controlled Substances Act.

 

 

 

DELTA-8 - WHERE CAN GEORGIA BE PURCHASED?

 

Delta-8 products can be purchased in-store from dispensaries and CBD vendors or online from licensed sellers. Some of these products can be dangerous, even though they are sold at gas stations.

 

However, CBD, THC and other hemp derivatives cannot be added to food and beverages intended for human and animal consumption. Delta-8 is not allowed in food, beverages, animal feed, or dietary supplements.

 

 

DELTA-8 THC LOOKS RIGHT UNDER FEDERAL LAW:

 

The legality of delta-8 THC at the federal level is in question. According to an Interim Final Rule (IFR) issued by the Drug Enforcement Agency (DEA), all "synthetically-derived" THC--products produced by chemical or biochemical synthesis--must remain under Schedule I of the Controlled Substance Act. Delta-8 is technically a federally controlled substance because it involves the use of chemicals in a CBD transformation process.

Is DELTA-8 THC legal in all 50 states?

 

While delta-8 THC in Georgia is legal, fifteen states have banned or restricted its use. Six other states are also reviewing the product's legal status. These products can look almost like candy to children. They contain Delta-8 THC (which can cause mild highs and pose a danger to children).
